Terms and Conditions of Service

Welcome to the official website and community platform of the Egba Association of Indiana (egbaassociationofindiana.org). By accessing our website, registering as a member, participating in our cultural events, or contributing through donations, you agree to comply with and be bound by the following Terms and Conditions ("Terms"). Please read these terms carefully before proceeding.

1 Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between you ("User," "Member," "Donor," or "Visitor") and the Egba Association of Indiana ("we," "us," or "the Association"), a cultural and community non-profit organization located in Indiana, United States.

By browsing, accessing, or using this website, completing online forms, or participating in association programs, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, and any additional rules applicable to specific association activities. If you do not agree with any part of these Terms, please refrain from using our website and services.

2 Mission & Organizational Purpose

The Egba Association of Indiana operates under our constitutional motto: "Unity in Culture, Strength in Community" and guiding slogan: "Preserving Our Heritage, Building Our Future."

Our core mission is to foster unity among Egba descendants, promote cultural awareness, support community development, and empower members through education, social engagement, and mutual welfare. All activities conducted through this website and within the association are dedicated exclusively to charitable, educational, cultural, and community development purposes.

3 Membership Eligibility & Registration

Membership in the Egba Association of Indiana is subject to review and confirmation by the Executive Committee in accordance with the Association's Constitution and Bylaws:

  • Eligibility: Membership is open to all descendants of Egbaland (including Abeokuta, Owu, Gbagura, Oke-Ona, and surrounding historic Egba communities), their spouses, and families residing in the State of Indiana and neighboring communities.
  • Account & Registration Accuracy: Prospective members and registered users must provide accurate, current, and complete personal information on all registration forms and update this information as necessary.
  • Membership Standing: Members in good standing are entitled to participate in general meetings, voting in leadership elections, social welfare programs, and association delegations. Failure to abide by association bylaws or maintain dues may affect membership status.

4 Code of Conduct & Community Standards

We are committed to maintaining a welcoming, respectful, and dignified environment for all members, families, and guests. When interacting through our digital platforms or at community functions, you agree not to:

  • Engage in any form of harassment, hate speech, defamation, discrimination, or abusive conduct toward any member, leader, or guest.
  • Post or transmit unsolicited commercial solicitations, spam, promotional advertisements, or fraudulent schemes without explicit executive authorization.
  • Attempt to gain unauthorized access to our administrative databases, website servers, user records, or payment systems.
  • Misrepresent your identity or falsely claim to speak or act on behalf of the Egba Association of Indiana without written mandate from the Executive Committee.

Note: Violations of this Code of Conduct may result in immediate suspension or termination of membership, restricted access to events, and necessary legal remedies under Indiana law.

5 Donations, Payments & Financial Contributions

The Association relies on the generosity of members, donors, and sponsors to fund cultural celebrations, educational scholarships, and community welfare programs:

  • Voluntary Contributions: All monetary donations made through egbaassociationofindiana.org/donate are voluntary contributions dedicated to the charitable and cultural purposes of the Association.
  • Payment Processing: Online donations and dues are processed through secure, PCI-compliant third-party payment gateways. We do not store full credit or debit card numbers on our local servers.
  • Refund Policy: Because donations are immediately dedicated to community programs, contributions are generally non-refundable. However, if a donation was made in error (such as an unintentional duplicate transaction or unauthorized card usage), please notify us within fourteen (14) business days at support@egbaassociationofindiana.org for prompt review and resolution.
  • Receipts: An electronic confirmation receipt is issued for every completed online contribution for your financial records.

6 Events, Cultural Gatherings & Media Consent

The Egba Association of Indiana regularly hosts cultural festivals (including Lisabi Day commemorations and Egba Cultural Day), family picnics, youth workshops, and celebratory galas:

  • Participation & Safety: Attendees agree to comply with venue regulations, safety guidelines, and event committee directives. The Association is not liable for personal property lost, stolen, or damaged during community events.
  • Media & Photography: Public cultural events may be photographed, videotaped, or livestreamed for community archives, newsletters, cultural documentation, and promotional purposes on our website and social channels. Attending public gatherings constitutes consent to inclusion in collective event media.

7 Intellectual Property & Website Content

All original content on egbaassociationofindiana.org—including the Association name, logos, crests, texts, articles, graphics, photography, and site layout—is the intellectual property of the Egba Association of Indiana and is protected by United States and international copyright, trademark, and intellectual property laws.

You may view, download, or print portions of the website for personal, non-commercial, and cultural educational reference only. You may not republish, reproduce, distribute, or commercially exploit any material from this site without prior written consent from our Executive Committee.

8 Privacy & Data Protection

Your privacy is of utmost importance to us. Any personal information gathered through contact forms, membership applications, newsletter subscriptions, or online donations is managed strictly in accordance with our Privacy Policy. We do not sell, rent, or trade your personal data to outside commercial marketers.

9 Disclaimer of Warranties & Limitation of Liability

This website and all information, services, and materials contained herein are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

While the Egba Association of Indiana makes every reasonable effort to keep information accurate and up to date, we do not warrant that the website will operate uninterrupted or error-free. To the fullest extent permitted by Indiana law, the Association, its executives, trustees, and volunteers shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use this website.

10 Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Indiana and the applicable federal laws of the United States of America, without giving effect to any principles of conflicts of law.

In the spirit of African communal brotherhood and mutual understanding, any dispute, controversy, or claim arising out of or relating to these Terms or Association activities shall first be submitted to the Association's Council of Elders and Executive Committee for amicable, good-faith community mediation before initiating any formal court proceedings in the state or federal courts situated in Marion County, Indiana.

11 Amendments & Updates to Terms

The Executive Committee reserves the right to revise or update these Terms and Conditions periodically to reflect changes in our community operations, legal obligations, or website capabilities. Any revisions will be published on this page with an updated "Effective Date." Continued use of our website or membership services following any modifications constitutes your formal acceptance of the revised Terms.
